These Terms & Conditions govern your use of the Asia Global Yachting platform and services. Please read them carefully before using our platform.
1. Acceptance of Terms
By accessing or using the Asia Global Yachting ("AGY") intranet platform, booking calendar, and related services, you agree to be bound by these Terms & Conditions. If you do not agree, please do not use the services.
2. Use of the Platform
Our platform is provided for authorised staff, partners, agencies, and charter clients to manage bookings, vessel operations, maintenance, finance, and related business processes. You agree to use the platform only for lawful purposes and not to misuse, disrupt, or attempt to gain unauthorised access to any part of the system.
3. Bookings & Charters
Charter quotations, availability, and pricing shown on our platform are indicative and subject to written confirmation. A booking is only confirmed once a deposit has been received and a written confirmation issued by AGY. Vessel specifications, rates, and itineraries may change without notice.
4. Payments
Unless agreed otherwise, a deposit is required to confirm a booking, with the balance due prior to departure. Payment terms, accepted methods, and cancellation terms are set out in your booking confirmation and invoice. Invoices are issued in the currency stated on the invoice.
5. Cancellations & Refunds
Cancellation and refund terms are governed by the conditions stated in your booking confirmation. Cancellations may be subject to charges depending on timing and the circumstances of the booking.
6. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us promptly of any unauthorised use of your account or any other security breach.
7. Intellectual Property
All content, branding, vessel photography, itineraries, and materials provided through the platform are the property of AGY or its licensors and are protected by applicable intellectual property laws. You may not reproduce or distribute such content without our prior written consent.
8. Liability
AGY provides the platform on an "as is" basis. To the extent permitted by law, we exclude liability for indirect or consequential loss arising from your use of the platform. Our liability for any direct loss is limited to the amount you have paid to AGY for the relevant booking.
9. Third-Party Services
Our platform may connect to third-party services (such as accounting and payment providers). We are not responsible for the practices or content of those third parties, and their terms may apply to your use of their services.
10. Changes to These Terms
We may update these Terms & Conditions from time to time. Continued use of the platform after a change constitutes acceptance of the updated terms.
11. Governing Law
These terms are governed by the laws applicable to the jurisdiction in which Asia Global Yachting operates the relevant booking, without regard to conflict of law principles.
